isp.net Terms of Service

These Terms of Service (the "Agreement") constitute a legally binding agreement between the customer ("Customer," "you," or "your") and ISP Industries LLC, a Nevada limited liability company doing business as isp.net ("isp.net," "we," "us," or "our"), a wireless internet provider based in Las Vegas, NV. By activating or using any isp.net services, you agree to be bound by the following terms.

1. Services Provided

isp.net provides high-speed wireless connectivity and integrated digital solutions. Our services are categorized as follows:

  • Core Internet Services: HomeNet (residential), BizNet (business), MultiNet (MDU/multi-site), PremiumNet (dedicated high-performance), and ColoNet (data center colocation).
  • Add-on Network Services: AirNet (managed Wi-Fi), VoiceNet (VoIP), VisionNet (smart surveillance), and AccessNet (door access systems).

2. Pricing and Billing

2.1 Fixed Rate & Forever Pricing

isp.net offers "Fixed Rate & Forever Pricing." Your monthly recurring charge (MRC) for the base service plan selected at the time of signup will never increase as long as the account remains active and in good standing at the original service address. Standard government-mandated taxes and fees associated with the base monthly service rate are included in this price.

2.2 Relocation

Fixed pricing is location-specific. If the Customer moves to a new address, the "Fixed Rate & Forever Pricing" for the original location ends. A new site survey and service agreement at then-current rates may be required for the new premises.

2.3 Exclusions & Activity-Based Charges

Fixed pricing applies only to the base monthly service rate. It does not apply to:

  • One-Time Fees: Service call fees ($100.00), equipment replacement/damage due to customer negligence, or the addition of new products/services.
  • Usage-Based Fees: Including but not limited to Toll-Free (inbound) minutes, International calling, or Excessive 911/E911 Usage Fees.
  • Unregistered 911 Calls: A fee of $100.00 per call will be applied if a 911 call is placed from an address other than the registered service address on file.
  • Excessive 911 Usage: Usage exceeding two (2) 911 calls per month per line is considered "Excessive Usage." For every 911 call placed after the second call in a single billing cycle, a $20.00 Excessive 911 Fee will be applied to the account.
  • Nuisance Calls: If isp.net is fined by a municipality or carrier for "nuisance" or non-emergency calls placed to 911, the full amount of the fine plus a 15% administrative fee will be billed to the Customer.

2.4 Payments

Payments are due monthly. Failure to pay on time may result in service suspension or termination.

2.5 Cancellation and Early Termination

All cancellation requests must be submitted in writing. Customers may cancel by submitting a request via their authenticated portal account (portal.isp.net) or by emailing Billing@isp.net from the authorized email address on file.

  • 30-Day Notice: Cancellations require a 30-day advance notice from your standard billing cycle date. If a cancellation request is made with less than 30 days' notice, you are responsible for paying the full balance of the final 30-day period.
  • Term Agreements: If your service is governed by a fixed-term agreement and is canceled prior to the expiration of that term, you are responsible for paying an Early Termination Fee (ETF) equal to the remaining balance of the agreement. isp.net will provide the final balance due upon termination of service.

2.6 Refund Policy

All sales are final. Except as explicitly stated in this Agreement, isp.net does not offer refunds or exchanges on any products, services, or installation fees.

  • Exception for Overpayments: The sole exception to this policy is in the event of an overpayment. If you have been charged more than the agreed-upon amount, you are entitled to a refund of the overpaid balance. To request a review, please contact our billing team at billing@isp.net or 702.900.0000 with your account details.
  • Management Rights: isp.net reserves all rights to make final decisions regarding refund requests and billing disputes.

3. Acceptable Use Policy & E911 Disclosure

3.1 Acceptable Use Policy (AUP)

All use of isp.net services is strictly governed by our Acceptable Use Policy (AUP). The AUP outlines rules regarding prohibited activities, network security, hardware tampering, spam, voice fair usage, and copyright compliance. By using our services, you agree to comply fully with the AUP.

3.2 VoiceNet E911 Disclosure and Limitations of Service

Customer acknowledges and understands that VoiceNet (VoIP) services operate differently than traditional telephone services. By using VoiceNet, you explicitly acknowledge the following limitations regarding Enhanced 911 (E911) emergency services:

  • Suspension for Non-Payment: If your isp.net account is suspended or terminated for non-payment, or for any other violation of this Agreement, YOUR ABILITY TO DIAL 911 WILL BE DISABLED immediately.
  • Power and Internet Outages: VoiceNet requires both a fully functioning internet connection and continuous electrical power to operate. In the event of a power outage, network disruption, or localized internet failure, E911 services will be unavailable until power and service are restored. We strongly recommend maintaining a battery backup (UPS) for your equipment.
  • Relocation & Incorrect Address: E911 emergency services are routed to the physical address registered to your account. Prior to service activation, Customer is required to complete and verify a 911 Address Form via the isp.net client portal. If you move your VoiceNet equipment to a different physical location without updating your registered address in the portal, 911 calls will be routed to the wrong emergency center or dispatch to the wrong location.
  • Alternate Means of Contact: Customer acknowledges that isp.net strongly recommends maintaining an alternative means of accessing 911 emergency services, such as a cellular telephone or traditional copper landline.
  • Duty to Inform: Customer agrees to inform all residents, guests, employees, and babysitters present at the registered location of these E911 limitations.
  • E911 Limitation of Liability and Indemnity: TO THE MAXIMUM EXTENT PERMITTED BY LAW, ISP.NET, ITS OFFICERS, DIRECTORS, AND EMPLOYEES SHALL HAVE NO LIABILITY WHATSOEVER FOR ANY INJURY, DEATH, OR PROPERTY DAMAGE ARISING OUT OF OR RELATED TO THE INABILITY TO DIAL 911 OR ACCESS EMERGENCY SERVICE PERSONNEL. Customer agrees to defend, indemnify, and hold harmless isp.net from any third-party claims or suits related to the failure or unavailability of E911 services.

4. Operational Rules & Equipment

4.1 Network Maintenance

isp.net is responsible for the maintenance of our network and the equipment we provide. If a technician is dispatched to your premises and it is determined that the issue was not the fault of isp.net (e.g., issues caused by customer-owned hardware, third-party software, internal wiring, or local power failure), a Service Call Fee of $100.00 will be charged to your account.

4.2 Ownership & Liability

All equipment provided by isp.net remains the property of isp.net unless explicitly purchased. Customer is responsible for the replacement cost of any equipment damaged by negligence or unauthorized tampering. isp.net is not responsible for service interruptions caused by the failure of the Customer’s local power or third-party hardware.

4.3 Access to Premises & Landlord Authority

Customer grants isp.net authorized personnel the right to enter the premises during reasonable hours for installation, maintenance, or equipment removal. The Customer warrants that they have the authority to permit physical installation of equipment, including roof mounts and cabling. In the event a property owner or HOA objects to the installation, isp.net reserves the right to remove its equipment and terminate service. isp.net is not responsible for any lease violations, lost deposits, or HOA fines incurred by the Customer.

4.4 Relay Node Rights

Customer grants isp.net the right to utilize the installed equipment and the Customer’s premises as a "Relay Node" to provide service to other isp.net clients.

  • Hardware: isp.net may install additional antennas or hardware specifically for relay purposes. All such equipment remains the property of isp.net.
  • Power: Customer agrees to provide continuous, uninterrupted power for the equipment and shall not intentionally disconnect it.
  • Access: For relay-related maintenance, Customer grants isp.net 24/7 emergency access to the premises' exterior or rooftop. Any specific arrangements regarding site hosting will be addressed on a per-case basis.

5. Legal Protections & Dispute Resolution

5.1 Limitation of Liability & Data Loss

To the maximum extent permitted by law, ISP Industries LLC and isp.net shall not be liable for any indirect, incidental, or consequential damages. This includes, without limitation, the loss of data for ColoNet or PremiumNet clients. VisionNet and AccessNet are monitoring tools; isp.net does not guarantee the prevention of property loss or personal injury.

5.2 Force Majeure & Indemnification

isp.net shall not be liable for any service failure, delay, or property damage resulting from causes beyond its reasonable control, including but not limited to "Acts of God" (such as extreme weather, high winds, lightning, or ice loading), utility power grid failures, third-party fiber cuts, and acts of vandalism, sabotage, or equipment theft. This protection extends to service disruptions caused by restricted access to equipment sites, as well as signal interference or line-of-sight obstructions caused by atmospheric conditions, new construction, or growing vegetation. Furthermore, Customer agrees to indemnify, defend, and hold isp.net harmless from any and all third-party claims, liabilities, damages, or expenses (including legal fees) arising from the physical installation and presence of antennas, mounts, or cabling on the premises, except where such damage is the direct result of isp.net’s proven gross negligence or willful misconduct.

5.3 Notice of Damage and Right to Repair

isp.net prides itself on professional installation; however, the Customer acknowledges that installation requires physical attachments and penetrations to the building’s exterior and interior. In the event the Customer alleges that isp.net has caused damage to the property (including but not limited to roof leaks, wall damage, or cabling issues) during installation or maintenance:

  • Timely Reporting: Customer must provide written notice of the alleged damage to isp.net within thirty (30) days of the date the damage was discovered or should have reasonably been discovered.
  • Right to Inspect: Upon receipt of notice, Customer must grant isp.net (or our authorized contractor) access to the premises within a reasonable timeframe to inspect and verify the alleged damage.
  • Right to Remedy: isp.net shall have the first right to repair or "cure" any verified damage caused by its workmanship. isp.net may, at its sole discretion, perform the repair itself or hire a licensed third-party contractor of its choosing.
  • Exclusion of Unauthorized Repairs: isp.net shall not be liable for, nor shall it reimburse the Customer for, any costs associated with repairs performed by the Customer or a third-party contractor without the prior written authorization of isp.net.
  • Condition Precedent to Litigation: Compliance with this "Notice of Damage and Right to Repair" process is a condition precedent to filing any legal claim or arbitration against ISP Industries LLC or isp.net.

5.4 Dispute Resolution by Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

a. Informal Dispute Resolution: Before initiating arbitration, you and isp.net agree to first attempt to resolve any dispute, claim, or controversy informally for at least thirty (30) days. You must send a written "Notice of Dispute" to isp.net detailing the nature of the claim and the requested relief.

b. Binding Arbitration: If the dispute cannot be resolved informally, both parties agree that any and all disputes arising out of or relating to this Agreement, your use of the Services, or equipment provided by isp.net shall be resolved exclusively through final and binding arbitration, rather than in court. The Federal Arbitration Act (FAA) governs the interpretation and enforcement of this arbitration provision.

c. Arbitration Procedures: The arbitration will be administered by the American Arbitration Association (AAA). For Residential accounts, the AAA's Consumer Arbitration Rules will apply. For Business accounts, the AAA's Commercial Arbitration Rules will apply. The arbitration shall be conducted by a single, neutral arbitrator. For Business accounts, the arbitration hearing will take place exclusively in Clark County, Nevada. For Residential accounts, the arbitration hearing will take place in the county of your registered service address. Regardless of account type, you and isp.net agree that the arbitration will primarily be conducted via telephone, video conference, or based solely on written submissions, unless the arbitrator determines that an in-person hearing is strictly necessary.

d. Arbitration Fees: The payment of all filing, administration, and arbitrator fees will be governed by the AAA's Consumer Arbitration Rules. However, if your claim seeks less than $10,000 in damages, isp.net will reimburse you for your portion of the AAA filing fee upon written request, unless the arbitrator determines that your claim is frivolous or brought for an improper purpose. Each party shall remain responsible for their own attorney's fees.

e. Exceptions to Arbitration: Notwithstanding the foregoing, either party may bring an individual action in small claims court. For Business accounts, such actions must be brought in Clark County, Nevada. For Residential accounts, such actions may be brought in the county of your registered service address, provided the claim qualifies. Additionally, isp.net retains the right to apply to any court of competent jurisdiction for injunctive relief to prevent intellectual property infringement, network abuse, or violations of the Acceptable Use Policy.

5.5 Class Action and Jury Trial Waiver

YOU AND ISP.NET AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, REPRESENTATIVE, OR CONSOLIDATED PROCEEDING. FURTHERMORE, BOTH PARTIES HEREBY WAIVE ANY CONSTITUTIONAL OR STATUTORY RIGHT TO SUE IN COURT AND HAVE A TRIAL IN FRONT OF A JUDGE OR JURY.

5.6 Conflict of Terms

In the event of a conflict between these Terms of Service and a signed Master Service Agreement (MSA) or specialized Service Order, the terms of the MSA or Service Order shall take precedence regarding that specific conflict.

5.7 Governing Law & Exclusive Venue

This Agreement, and any disputes arising out of it, shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law principles. In any circumstances where the Arbitration agreement in Section 5.4 permits the parties to litigate in court (such as small claims or exceptions), both parties hereby consent to the personal and exclusive jurisdiction of the state and federal courts located within Clark County, Nevada for Business accounts, or the county of the registered service address for Residential accounts, and waive any objections to venue in such courts.

5.8 Privacy Policy

Your use of our services is also subject to the isp.net Privacy Policy, which governs how we collect and use your data.

I've had ISP.net for 10 years. I'm a residential customer and when I say I've never had an outage or slow uploads/downloads speeds belive me. I kinda chuckle at all the comments out their who have the bigger know names for service when they complain about service, price and reliability I wish I could tell them get ISP.net. pricing is very competitive for the what's out there. If I do need to call about change of email or phone number I speak to someone right away and I love that its a local business. Give them a call and try it out.

So I want to start by saying how insanely busy I am all the time. Im a Chef and I never know which way Im going. Jae (in billing) has continuously been patient with me. Going above and beyond to help me understand everything from payment plans to new contracts and equipment. And honestly when I am confused or frustrated I can be very demanding until I completely understand. Jae never has had a problem emailing or calling to make sure all my paperwork and questions are answered. And I have so many questions lol. You can really tell they love what they do, and I hope they're rewarded often. Because we all know dealing with billing isn't always fun. ISP.net's service itself isn't too bad -- the speeds are fairly reliable and I haven't run into many issues. That said, the pricing is definitely on the higher side compared to other options, so that's something to keep in mind. What really makes the difference, though, is their support team. Anytime I've had questions or needed help, they've been quick, professional, and friendly. I especially want to give a shoutout to Jae from the billing department -- absolutely wonderful to work with, super patient, and really went above and beyond to make sure everything was taken care of. Overall, while the cost is a bit steep, the excellent customer support makes the experience much better.
